1. Acceptance of Terms

By accessing or using Troxler's website, mobile applications, or any other services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Eligibility and Age

Troxler is a research and analytics service. It is not a sportsbook, it does not accept wagers, and it does not process any gambling transaction. You may use the Service only if you are of legal age in your jurisdiction to enter into a binding contract, and in any case at least 18 years old.

Where you use anything you read here in connection with real-money wagering, you are responsible for meeting the legal age and eligibility rules that apply to you. In most United States jurisdictions that age is 21. Nothing on the Service is a recommendation to place a wager.

We do not knowingly collect information from anyone under 13. If you believe a child has provided us information, write to support@troxler.io and we will delete it.

3. Description of Service

Troxler provides quantitative research on sports and prediction markets. Our Service includes model-generated predictions, statistical analysis, market-price comparison, and research tools. Troxler is not a sportsbook, does not accept or place wagers, and does not provide betting advice.

The Service is intended for research and informational purposes only. Troxler does not operate as a sportsbook, accept wagers, or facilitate gambling transactions.

4. User Responsibilities

By using the Service, you agree to:

• Be at least 21 years of age (or the legal gambling age in your jurisdiction)
• Use the Service only in jurisdictions where sports betting is legal
• Provide accurate and complete information when creating an account
• Maintain the confidentiality of your account credentials
• Not share, resell, or redistribute our content without authorization
• Not use the Service for any illegal or unauthorized purpose
• Not attempt to gain unauthorized access to our systems or other users' accounts
• Gamble responsibly and within your means

5. Intellectual Property

All content, features, and functionality of the Service—including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the compilation thereof—are the exclusive property of Troxler Analytics, LLC (operating as Troxler) and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from the Service without our prior written consent.

6. Disclaimer – No Guarantee of Results

TROXLER DOES NOT GUARANTEE ANY PARTICULAR OUTCOME OR RESULT FROM USING OUR SERVICE.

Markets involve inherent risk, and past performance does not guarantee future results. Our published predictions and analysis are based on statistical models and historical data, but sports outcomes are inherently unpredictable.

You acknowledge that:

• All betting decisions are made at your own risk
• You may lose money by following our published predictions or using our analysis
• We provide information only; we do not provide financial or betting advice
• You are solely responsible for any bets you place

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TROXLER ANALYTICS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Financial losses from betting activities
• Interruption of service or loss of access
• Any damages arising from your use or inability to use the Service

In no event shall our total liability exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.

8. Subscription and Payments

Troxler is currently free. If and when paid features are offered, the terms below will apply to any subscription you choose to purchase. By subscribing, you would agree to:

• Pay all applicable fees as described at the time of purchase
• Automatic renewal of your subscription unless cancelled before the renewal date
• Our refund policy as stated at the time of purchase

We reserve the right to change our pricing at any time. Any price changes will be communicated to you in advance and will take effect at the start of your next billing cycle.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

10. Copyright Complaints and DMCA

We respect copyright. If you believe material available on the Service infringes a copyright you own or represent, send a written notice to our designated agent with all of the following: your physical or electronic signature; identification of the work you say is infringed; identification of the material you say is infringing and enough detail for us to locate it; your address, telephone number and email address; a statement that you have a good faith belief the use is not authorised by the copyright owner, its agent or the law; and a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on the owner’s behalf.

We will remove or disable access to material we determine is infringing, and we may terminate the accounts of repeat infringers. If you believe material was removed in error, you may send a counter-notice to the same address containing your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good faith belief it was removed by mistake or misidentification, and your consent to the jurisdiction of the federal court named in the Governing Law section.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.
